Shipping

WE CURRENTLY SHIP WITHIN AUSTRALIA ONLY

We attempt to ship all orders as soon as possible using the best courier option for the receiver’s location. In most cases we ship within 1-2 business days from receiving your order, if not the same day. 

We will notify you of shipment and provide you with a tracking number by email. You can track your delivery via Australia Post. 

Delivery times may vary, especially during peak periods such as Black Friday, Stock Take and Christmas. Delivery is also subject to stock availability. Weekends and Public holidays may delay delivery.

You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your products to the wrong address, or wrong person as a direct result of you providing us with inaccurate or incomplete information.

Within Australia

Body by Lu delivers through Australia Post.  As we are located outside of the Express Post zone, we do not offer this service to our customers as next-day delivery is not guaranteed.

For retail customers in NSW, ACT, VIC, TAS, SA, WA, QLD & NT the following rates apply:

· Flat rate standard post (under 5kg) is $13.65**

**NOTE: Should your order exceed 5kg, we will contact you with an update to the correct postage costs for your further instruction.

All prices are in Australian dollars (AUD) and include postage and handling.

Damages and issues

We want you to be satisfied with the products that you purchase. This is why we ask that you check the quantity and quality of your purchased products upon delivery and if any products are faulty or incorrectly supplied that you notify us immediately.

Sometimes during freight items can be damaged, so please let us know if this is the case. Please understand all products are securely packed and all products are quality checked prior to shipping, and we do not take any responsibility for damage caused in transit.  You will be provided with a tracking number for your order to contact Australia Post with your concerns. 

Returns / Exchanges / Refunds

We do not accept returns of used products, or products with broken security seals. As all our products are personal care items, these cannot be returned for health reasons. 

Please note that because our products are handmade, individual batches may vary slightly in colour, texture or smell. This in no way affects their quality and cannot be the reason for a return.

We only offer replacements or refunds for products when the major failure or damage occurred before use due to problems during manufacture.  All products are quality checked prior to fulfilling orders.  We do not offer refunds for change of mind purchases, or for products with minor flaws. Only for products with major failures that render the item unusable, according to Australian Consumer Law.  

All soap is moulded and cut by hand which means every bar is naturally unique; so please beware that no two bars are ever identical in appearance. This does not affect their quality and cannot be the reason for a refund.

To process a replacement or refund for a faulty product, contact us via email, enquiries@bodies-bylu.com. Please include your order number, so we can identify your purchase, the details of the product in question and a photo of the major failure or damage due to manufacture.  Any costs incurred by the individual if they do return a product will not be reimbursed.

Please contact us if you need to cancel an order you placed or would like it changed or varied. If you place an order and would like it cancelled before it is shipped, we can arrange a refund.

Sale of Products

These Terms and Conditions govern the sale of products available on the Site. The following products are available on the Site:

• Face Masks;
• Lip Balms;
• Hair Oil; and
• Tallow balm

These Terms and Conditions apply to all the products that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our products are as accurate as possible.  However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all products we provide. It is your responsibility to read all labels and information provided to you.  You agree to purchase products from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.  

Product Availability

Please note that from time to time products listed in stock may not be available. If this occurs, we will notify you by telephone or email to seek your instructions for a suitable replacement. If you prefer, we will refund any charges incurred for that product.

As our products are hand produced in small quantities, slight variances in colour or appearance (in particular soap tops) may occur, this variance will not affect the quality, usability or the way the product performs.

Payments

We accept the following payment methods on our website:

• Credit Card;
• Debit Card.

When you provide us with your payment information, you authorise our use of an access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Shipping and Delivery

When you purchase products from our Site, the goods will be delivered by Australia Post, and it’s international partners internationally.  Delivery will take place as soon as reasonably practicable. Delivery times may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and public holidays.

You will be required to pay delivery charges in addition to the price for the products you purchase.

If you purchase goods from us for delivery to a destination outside of Australia, your purchase may be subject to import duties and taxes applied by the destination country. You are responsible for ensuring your purchases meet customs regulations for their country and paying any duties and taxes. Please contact your local customs office for more information before making a purchase. We are not responsible for the payment of any such duties or taxes and are not liable for any failure by you to pay them.

You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your products to the wrong address, or wrong person as a direct result of you providing us with inaccurate or incomplete information.

Consumer Protection Law

Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

No Guarantees

The Site and its content are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Site will be error-free, secure, or uninterrupted.

Limitation of Liability

Body by Lu and our directors, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages (including direct, indirect, incidental, or consequential damages), liabilities and expenses including legal fees from your use of the Site.

Except where prohibited by lay, by using this Site you agree to indemnify and hold harmless Body by Lu and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, liabilities, damages, costs, or expenses including legal fees arising from your use of the Site, violation of these Terms and Conditions, or infringement of third-party rights.

Modifications to Terms and Conditions

We reserve the right to update these Terms at any time without prior notice in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. Changes will be posted on this page and continued use of the Site after modifications indicates your acceptance of the updated Terms.

Termination

We may suspend or terminate your access to the Site at our discretion, without prior notice, for violations of these Terms or other reasons.

Dispute Resolution

Subject to any exceptions specified in these Terms and Conditions, if you and Body by Lu are unable to resolve any dispute through informal discussion, they you and Body by Lu agree to submit the issue before a mediator. The decision of the mediator will not be binding. Any mediator must be a neutral party acceptable to both you and Body by Lu.

Notwithstanding any other provision in these Terms and Conditions, you and Body by Lu agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Applicable Law

These Terms and Conditions and your use of the Site shall be governed by the laws of the State of New South Wales.
